Rent To Own Agreements Are Confusing

Who is the landlord? Is there a rental license? Who does the maintenace? Who is responsible for the repairs? What happens when your rent to own contract expires? Is there an option to excercise your right to buy ealrier? Are there penalties? Etc .... These are just some of the questions that we constantly hear from our clients.

How Does Rent-to-Own Work?

  • Agreement: A rent-to-own agreement is signed, outlining the terms, including the lease period, future purchase price, and how much of the rent will go towards the purchase. Some programs will create a preliminary draft of the purchase agreement with pre-negotiated terms of the contract which theld be used as a guide for the future transaction.
  • Lease Period: During this period, the tenant pays rent. Sometimes a portion of which is set aside to be used for the future down payment. Some arrangements treat it strictly as a rent payment.
  • Option to Purchase: At the end of the lease period, the tenant has the option to buy the property at the agreed-upon price.

Pros and Cons of Rent-to-Own


  • Build Equity: Part of your rent goes towards the down payment (not in every program). 
  • Time to Improve Finances: Improve your credit score or save more money.
  • Lock in Purchase Price: The purchase price is set when you sign the agreement. Most rent to own agreements will allow you to lock in your price now so you dont have to pay market price later. Other programs will have a pricing schedule.

  • Non-Refundable Fees: Option fees and rent credits may be non-refundable if you decide not to purchase. Every program is different.
